1. Acceptance of Terms

By accessing or using ListCreative ("the Service"), operated by ListCreative Inc., you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ListCreative is an AI-powered tool that generates product listings, creative images, and marketplace-ready assets for Canadian ecommerce sellers. The Service includes listing copy generation, creative image generation, and related tools.

3. Account Registration

To use certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information.

4. User Content

You retain ownership of all content you upload to the Service, including product images, text, and brand assets.

By uploading content, you grant ListCreative a limited license to process your content solely for the purpose of providing the Service to you.

You are responsible for ensuring you have the right to use any content you upload, including images, trademarks, and copyrighted material.

5. Generated Content

All listings, creatives, and assets generated by the Service using your input are owned by you. You may use generated content for any lawful commercial purpose, including publishing on marketplaces, social media, and websites.

6. Pricing & Payment

Prices are listed in Canadian Dollars (CAD). We reserve the right to change pricing with 30 days' notice.

Subscriptions renew automatically. You may cancel at any time through your account settings.

Refunds are available within 14 days of purchase if you have not generated more than 5 outputs.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on third-party rights
• Attempt to reverse-engineer or extract the AI models
• Resell or redistribute the Service without authorization
• Generate misleading or fraudulent product listings

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. Scheduled maintenance will be communicated in advance when possible.

9. Limitation of Liability

ListCreative is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Alberta, Canada.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
